Modification Of These Terms And Conditions
GOTOLATIN TRAVEL S.A. reserves the right to change this Agreement at any time
by revising the terms and conditions herein. Customer is responsible
for regularly reviewing these terms and conditions. Continued use
of this Web site following any such changes shall constitute the
Customer's acceptance of such changes.
General
GOTOLATIN TRAVEL S.A. reserves the right to make any and all changes to this
Web site at its sole discretion without notice to the Customer.
GOTOLATIN TRAVEL S.A. reserves the right to deny access to this Web site to
anyone at anytime.
This Agreement shall be deemed to include all other notices, policies,
disclaimers, and other terms contained in this Web site; provided,
however, that in the event of a conflict between such other terms
and the terms of this Agreement, the terms of this Agreement shall
control.
Customer acknowledges that no joint venture, partnership, employment,
or agency relationship exists between the Customer and GOTOLATIN TRAVEL S.A.
as a result of this Agreement or use of this Web site. Customer
agrees not to hold himself or herself out as a representative,
agent, or employee of GOTOLATIN TRAVEL S.A. and Go Chile shall not be liable
for any representation, act or omission of the Customer.
Gotolatin's performance of this Agreement
is subject to existing laws and legal process and nothing contained
in this Agreement
is in derogation of Gotolatin 's right to comply with law enforcement
requests or requirements relating to the Customer's use of this
Web site or information provided to or gathered by GOTOLATIN
TRAVEL S.A. with
respect to such use.
If any part of this Agreement is determined to be invalid or unenforceable
pursuant to applicable law including, but not limited to, the warranty
disclaimers and liability limitations set forth above, then the
invalid or unenforceable provision will be deemed superseded by
a valid, enforceable provision that most closely matches the intent
of the original provision and the remainder of the Agreement shall
continue in effect.
This Agreement constitutes the entire agreement between the Customer
and GOTOLATIN TRAVEL S.A. with respect to this Web site and it supersedes all
prior or contemporaneous communications and proposals, whether
electronic, oral or written, between the Customer and Go Chile
with respect to this Web site. A printed version of this Agreement
and of any notice given in electronic form will be admissible in
judicial or administrative proceedings based upon or relating to
this Agreement to the same extent and subject to the same conditions
as other business documents and records originally generated and
maintained in printed form.
Commercial Policies
General
Our Company is specialized in offering information for the travelers
who choose the country as destination for their trips, being these
of businesses, educative, special interests or simply pleasure.
In the same way, we are legally authorized to exert the commerce
like Travel Agency and Publicity. In the scope of the tourism we
act like hotel reservations central, aerial ticket reserves and
sales, reserves and sales of tours, and reserve of rent-a-car
Payment Terms
Our Company acts in three different modalities to receive the payments
that client makes to liquidate the required services:
- The intermediate of information
- Charge on the credit card of the client
- Client deposits in the bank account of the Company in our country
or New York, USA.
Hotels
With respect to hotel reserves, our Company acts as an intermediate
of information and asks for the number of credit card of the passenger
only as a guarantee of reservation. Our Company will not carry
out any charge to the cardholder, it only transfers the information
from the client to the hotel that this one has selected. It is
therefore the hotel that finally will charge the passenger for
the lodging and services that passenger has used in the hotel.
The return policy change according to each hotel and it is responsibility
of the passenger to be aware of them
Aerial tickets
For the aerial ticket issue, our Company will charge it on the
credit card of the client, or the client will deposit in our banking
current accounts in our country or New York, USA, the amount of
the asked ticket, plus the corresponding aeronautical tax. The
policy of returns will become according to the rules that each
airline determines for the different classes of its tickets. Our
Company is committed to give back to the passenger, the amount
received by the airline, within the following 7 days upon reception
of reimbursement by aerial ticket asked for by our mediation.
Tours
For reserve of tours, our Company will act as following:
1.- Like intermediate of information. Asking number of credit
card, only to guarantee the passengers reservation. Our Company
will not carry out any charge to the cardholder, we only transfer
the information of the client to the operator of the tourism package
whom this has selected. It is therefore the operator that finally
will charge the passenger for the services. The return policies
change according to each operator and it is responsibility of the
passenger to be aware of them.
2.- Charging on the credit card of the client, or the client will
deposit in our bank accounts in our country or New York, USA, the
amount of tour required. The policy of returns will become according
to the rules that each operator determines. Our Company is committed
to give back to the passenger, the amount received by the operator,
within the following 7 days upon reception of refund by tour required
by our mediation
Rent a Car
As to rent-a-car, our Company acts as intermediate of information
and asks for the number of credit card only to guarantee the passengers
reservation. Our Company will not carry out any charge to the cardholder,
we only transfer the information of the client to the operator
whom this has selected. It is therefore the operator who finally
will receive the passenger for the services, which the passenger
has incurred. The return policy change according to each operator
and is responsibility of the passenger to be aware of them.
